1. Definitions and Acceptance

To establish a mutual understanding within these Terms of Service, Privacy Policy, Disclaimer, and all related agreements, we've outlined key definitions. "Client," "You," and "Your" represent the individual or entity engaging with our website and utilizing our Services. "The Company," "Ourselves," "We," "Our," and "Us" identify Biz Reach Pro. "Party" or "Parties" refer to the collaborative relationship between the Client and Biz Reach Pro. These terms encompass the full scope of our service provision, including the offer, acceptance, and payment, to best serve your needs within legal parameters. By using our Services, you consent to the practices described in this policy.

2. Information We Collect

Personal Contact Information: Name, company name, address, phone number, and email address, collected when you express interest in or register for our Services.

Billing Information: Billing name, address, and credit card details. We utilize Stripe (www.stripe.com) for secure payment processing and do not store sensitive billing data on our servers.

Campaign & Message Data: Because we manage the outreach on your behalf, we collect and store SMS logs, delivery status reports, and interaction history as required for service quality and national telecommunications auditing.

Technical Information: Diagnostic data and analytics information (via Google Analytics) used to identify errors and improve functionality. You can opt out of personalized advertising via www.aboutads.info.

3. Sharing and Disclosure

Service Providers: We may share information with trusted third-party service providers (e.g., data storage, payment processing, or data providers) under strict confidentiality agreements.

Marketing and Publicity: We may identify you as a customer and use your name or logo in our marketing materials unless otherwise requested in writing.

Legal Compliance: We may disclose information to comply with legal obligations, respond to legal processes, or protect the rights and safety of Biz Reach Pro and our partners.

Business Transfers: In the event of a merger or acquisition, your information may be transferred to the successor company, subject to this policy.

4. Content Liability

While Biz Reach Pro facilitates outreach using third-party data, the Client bears sole responsibility for the professional conduct and representations made during the lead follow-up process.

Client Responsibility: Biz Reach Pro shall not be held accountable for any claims arising from the Client's specific interactions with leads or the content of their manual follow-up messages.

Defense of Claims: You are required to defend and protect Biz Reach Pro against any claims or legal actions resulting from your website content or business practices.

Indemnification: Client agrees to indemnify Biz Reach Pro from any and all penalties or damages arising from the Client's specific use of the leads outside of our managed platform.

5. Your Rights

EU Residents (GDPR): You have rights to access, rectify, erase, restrict processing, and data portability of your Personal Data.

California Residents (CCPA): You have rights to access, restrict, or delete your personal information. Please submit a request via [email protected].

Accuracy: You are responsible for keeping your contact and billing information up-to-date to ensure uninterrupted service.

6. Changes to This Policy

We reserve the right to update this policy at any time. Material changes will be communicated via email or posted prominently on our website. We encourage you to review this policy regularly to stay informed of our practices.

7. Pay-Per-Estimate (PPE) & The Friday Sync

For clients in the Pay-Per-Estimate pilot program:

Invoicing: Upon the completion of the 10th estimate, the Pay-Per-Estimate trial concludes; to maintain service and continue receiving leads, Client is required to transition to the Monthly Program.

The Friday Sync: To keep the pilot campaign active, Client must provide a status update for every lead delivered during the week. All updates and payments must be reconciled by Friday. Failure to do so will result in an immediate campaign pause.

Breach of Integrity Fee: Any attempt to bypass the reporting process or service a lead provided by Biz Reach Pro without reporting it will trigger an immediate $1,695.00 Integrity Fee and permanent termination of the partnership.

8. Project Execution & Partnership Policy

Setup Period: Onboarding requires up to a 3-business-day setup period following payment and form receipt.

Lead Fluctuation: SMS engagement is subject to homeowner behavior and carrier filtering. Biz Reach Pro does not guarantee a specific number of responses. Lead volume may fluctuate based on market density, price point, and client customer service.

Non-Refundable Work: Once data has been pulled, scrubbed, or campaign setup has commenced, payments are non-refundable.

9. Data Provision & SMS Compliance

Data Ownership: All homeowner data and phone lists provided by Biz Reach Pro or its third-party partners remain the exclusive property of Biz Reach Pro and its licensors.

Compliance Standards: We utilize verified third-party data to facilitate delivery. Client shall not attempt to circumvent mandatory "STOP" to opt-out features provided within the SMS campaigns.
